Terms of Service

1. Eligibility

Sellers

• You must be at least 18 years of age to create a seller account
• You must provide accurate and complete information during signup
• You must verify your email address before creating listings
• You are responsible for all activity that occurs under your account

Buyers

• You must be at least 13 years of age to use the Service as a buyer
• Guest buyers must provide a valid name and PayPal email address before claiming items
• By claiming an item, you agree to complete the purchase if invoiced by the seller

2. The Service

ComicHero provides a platform that allows comic book sellers to create online storefronts and manage sales, and allows buyers to browse and claim items.

We are a platform only. We do not buy, sell, or take possession of any items listed on the Service. We do not process payments between buyers and sellers. All transactions occur directly between buyers and sellers via PayPal.

3. Seller Responsibilities

As a seller, you agree to:

• List only items you own and have the right to sell
• Provide accurate descriptions, photos, and prices for all listings
• Set fair and clearly communicated shipping rates
• Honor all claims made by buyers in good faith
• Invoice buyers promptly after closing a sale
• Ship items within a reasonable timeframe after payment is received
• Communicate with buyers professionally and in good faith
• Comply with all applicable laws regarding the sale of goods
• Not engage in fraudulent, deceptive, or misleading practices
• Not list items that are illegal to sell in your jurisdiction
• Not list explicit adult content on the platform

Sellers who repeatedly fail to fulfill orders, engage in fraudulent activity, or violate these Terms may have their accounts suspended or permanently terminated.

4. Buyer Responsibilities

As a buyer, you agree to:

• Provide accurate name and PayPal email address when claiming items
• Complete purchases for items you claim when invoiced by the seller
• Pay invoices promptly upon receipt
• Communicate with sellers professionally and in good faith
• Not claim items with no intention of purchasing them

5. Payments and Invoicing

How Payments Work

ComicHero does not process payments between buyers and sellers. When a seller closes a sale, ComicHero generates a pre-filled PayPal invoice that the seller reviews and sends directly to the buyer via PayPal. Payment is made directly from buyer to seller through PayPal's platform.

PayPal Disputes

All payment disputes are between the buyer, the seller, and PayPal. ComicHero is not a party to any payment transaction and is not responsible for resolving payment disputes.

• Buyers: Contact the seller first. If unresolved, file a dispute directly with PayPal at paypal.com/disputes
• Sellers: Respond to buyer messages promptly. All PayPal disputes are governed by PayPal's resolution process

Our Fees

Sellers pay a flat monthly or annual subscription fee to use the Service. We do not charge transaction fees on any sales made through the platform.

6. Subscription Plans, Billing, and Cancellation

Plans

We offer subscription tiers with monthly and annual billing options. Plan details including pricing and listing limits are available on our pricing page.

Founding Member Pricing

The first 50 sellers to subscribe receive lifetime 50% off their chosen plan (“Founding Member Pricing”) as long as their subscription remains active. Founding Member Pricing is non-transferable and is permanently forfeited upon cancellation.

Cancellation

You may cancel your subscription at any time. Your store remains active until the end of your current billing period. No refunds are issued for monthly plans. No refunds for annual plans after 7 days from purchase. Founding Member Pricing is permanently forfeited upon cancellation.

Failed Payments

• We will retry failed payments automatically
• You will receive email notifications on Day 1 and Day 7 of the grace period
• After 14 days without successful payment, your storefront will be made unavailable
• After 30 days, your account will be suspended
• After 90 days, your data will be permanently deleted
• Payment recovered at any point during the grace period restores your store immediately

7. Content and Intellectual Property

Your Content

You retain ownership of all photos, descriptions, and other content you upload to the Service. By uploading content, you grant ComicHero a non-exclusive, worldwide, royalty-free license to display, store, and transmit your content solely for the purpose of operating the Service.

Prohibited Content

You may not upload or list:

• Items that are illegal to sell in your jurisdiction
• Counterfeit or fraudulently described items
• Explicit adult or sexually explicit content
• Content that infringes on the intellectual property rights of others

Our Intellectual Property

The ComicHero name, logo, platform design, and all associated intellectual property are owned by ComicHero. You may not use our branding or trademarks without our written permission.

8. Account Suspension and Termination

We reserve the right to suspend or terminate any account at our sole discretion if a user has:

• Violated these Terms of Service
• Engaged in fraudulent, deceptive, or harmful behavior
• Received multiple unresolved buyer disputes
• Failed to fulfill orders after receiving payment
• Provided false information during signup

Upon termination, your access to the Service will be revoked immediately. Any outstanding buyer claims or invoices remain your responsibility to resolve. You may terminate your account at any time by contacting us at support@comichero.app.

9. Seller Account Pause

Sellers may pause their storefront at any time using the vacation mode feature. When paused, your storefront displays “Temporarily Unavailable” to buyers, your listings are hidden but not deleted, and your subscription billing continues unless you cancel. You may unpause at any time to restore your storefront instantly.

10. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you agree to the collection and use of your information as described in the Privacy Policy.

11. Disclaimers and Limitation of Liability

The Service is provided “as is” and “as available” without warranty of any kind. To the maximum extent permitted by applicable law, ComicHero shall not be liable for:

• Any transactions between buyers and sellers, including payment disputes or non-delivery of items
• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or goodwill arising from your use of or inability to use the Service
• Any actions or omissions of third-party service providers including PayPal or Lemon Squeezy

Our total liability to you for any claim shall not exceed the amount you paid us in subscription fees in the 3 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless ComicHero and its founders, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your transactions with other users.

13. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will notify you by email at least 14 days before the changes take effect. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
